Terms of service

Version 1.8. Last updated November 4, 2026

These terms include an agreement to resolve disputes by individual arbitration and a class action waiver (see section 18).

These are the terms you agree to when you buy a Simp plan in the United States. They apply to customers who live in the United States.

Your plan renews automatically until you cancel. Section 5 explains how, and you can cancel online at any time.

Please read section 18. It says that you and we settle disputes by individual arbitration, not in court, and that neither of us can bring or join a class action. You can opt out of arbitration within 30 days of first agreeing to these terms.

1. Who we are

Simp is run by Simp Industries Ltd. Registered in England and Wales, company number 16366317. Registered office: 71-75 Shelton Street, Covent Garden, London, United Kingdom, WC2H 9JQ.

In these terms, "we", "us" and "Simp" mean that company, and "you" means the person who holds the account.

You can reach us at hello@simpmobile.com, or by talking to our support assistant in the Simp app or on our support page.

2. Who can use Simp

  • You must be 18 or over, or the age of majority where you live if that is higher.
  • You must live in one of the 50 states or the District of Columbia.
  • You must pay with a card issued in the United States.
  • Simp is for consumers. An account is for one person and for your own personal and household affairs, not for a business. You may not share your account or let anyone else give your simp instructions.
  • You sign in with Apple or Google. Keep that sign-in safe, and tell us straight away if you think someone else has used your account.
  • The details you give us must be true and kept up to date, especially your first name, because your simp gives it on calls.

3. What Simp is

Simp gives you your simp, an AI that makes phone calls for you, in the voice of the persona you choose. When you ask it to, your simp calls a number from your AI number, has the conversation, waits on hold, gets through phone menus and works towards the goal you set. It then reports back with the outcome, a summary and a transcript. Your simp also answers calls to your AI number and takes messages for you.

Simp is not a phone service. It does not give you a mobile line, a SIM card, mobile data or a number to use as your own phone. Keep your own phone plan.

No emergency calls. You cannot call 911, or any other emergency number, through your simp or your AI number. If you or anyone else is in danger, call 911 yourself, from your own phone.

Your simp is software. It does not give professional advice of any kind (legal, medical, financial or otherwise), and it can get things wrong (section 16).

We may change how Simp works at any time.

4. Plans, prices and payment

  • Simp AI: your simp, an AI number and 20 AI minutes each month.
  • Simp+: your simp, an AI number and 30 AI minutes each month, with spins (1 a week).
  • Simp Pro: your simp, an AI number and 50 AI minutes each month, with spins (1 a day), and autonomous mode.

The price of your plan, and how often you pay, are shown at checkout and in your account. You pay in advance for each billing period. Your first payment is taken on the day you join, and it is the full price for a whole billing period: a month, or 3 months on a plan paid up front. Each later payment falls on the same date as the day you joined, at the start of each new billing period. If you joined on a date a shorter month does not have, such as the 31st, it falls on the last day of that month.

Sales tax. Prices are shown without sales tax. Where we must collect sales tax or a similar tax, we add it at checkout before you pay and show it on your receipt.

How you pay. Your card details go straight to our payment provider and never reach us.

If a payment fails. We may suspend your service if a payment fails.

Changing your plan. Your account shows what a change costs and when it takes effect before you confirm it. Moving to a higher plan applies straight away, and you pay the difference for the rest of the current billing period. Moving to a lower plan, changing how often you pay, and cancelling all take effect at the end of the billing period you have paid for.

Codes. We check a code at checkout. You can combine several codes, and combined percentage discounts apply one after another, not added together. Each discount lasts as the code states: your first bill only, a set number of months, or for as long as you keep the plan. A code may be for new customers only, or for certain plans. You can use one referral per account, and not your own. We may refuse a code that has expired, has been used up or cannot be used on your order.

5. Automatic renewal

Your plan renews automatically until you cancel.

  • What renews: your plan, and any extra AI numbers you have added.
  • What you pay: the price of your plan for the billing period you chose, plus applicable sales tax, at the price in force when the new period starts. The price and the period are shown at checkout, next to the pay button, and in your account.
  • When you are charged: to the card on your account, on the day each new billing period starts, which is the same date as the day you joined (or the last day of a shorter month), until you cancel.
  • How to cancel: online, at any time, in your account on our website or in the Simp app.
  • When cancelling takes effect: your plan stops renewing straight away. It keeps working until the end of the period you have already paid for, then it ends and nothing more is charged.
  • Refunds: we do not refund any part of a billing period (section 6).

When you sign up, we send you a confirmation by email that repeats these renewal terms and tells you how to cancel.

6. Cancelling and refunds

You can cancel at any time, online, in your account or in the Simp app. Your plan stops renewing straight away and ends at the end of the period you have paid for.

Refunds. We do not refund any part of a billing period you have paid for, including when you cancel, except where the law requires a refund.

If we end your plan before the end of a period you have paid for, and it is not because you broke these terms, we refund the unused part of that period.

Cancelling does not delete your account. To delete your account, see our privacy policy.

7. Price changes

We may change our prices. A new price never applies to a period you have already paid for. We tell you by email 30 days before a new price applies to you. If you do not want to pay it, cancel before it applies.

A lower price applies to new customers only, unless we tell you otherwise.

8. Who is responsible for each call

You are the caller. You decide every call your simp makes, and you are responsible for it.

Simp provides the tool. You decide whether a call is made, who is called and what it is for, either call by call in the app or, on Simp Pro, as your say-so given in advance in autonomous mode.

You promise that you will only ask your simp to call:

  • a business; or
  • a person who gave you their number, or who agreed to be called by you or for you.

You are responsible for every call you ask for, and for every call made under rules you set. If you break this section, or section 13, you will pay us back for any claim, fine, penalty, damages and costs (including reasonable attorney's fees) that we face because of it.

Every call goes out on your AI number. The person called sees that number and can call it back, and your simp answers.

We may refuse to place a call, or end one, if we believe it breaks the law or these terms.

9. What your simp says on a call

At the start of every call it makes, your simp says that it is an AI calling from Simp for you, by your first name, and that this call is transcribed. When it answers your AI number, it tells the caller that it is an AI answering for you and that the call is transcribed. If anyone asks whether they are talking to an AI, it says yes.

Apart from your first name, your simp shares only what your sharing settings in the app allow.

If the person your simp is calling asks not to be called again, your simp ends the call and tells you, and we stop calls to that number.

10. Transcripts

Every call is transcribed while it happens. Calls are not recorded as audio. After each call you get the outcome, a summary and the transcript, and you can see them in the app for 30 days. You cannot delete a single call; deleting your account deletes them all. How we keep and use transcripts, including the "Help improve Simp" setting, is in our privacy policy.

A transcript holds what the other person said. Use it only for your own affairs.

11. Approvals, autonomous mode and connected AI apps

Your say-so. Your simp never calls without your say-so. You give it call by call, by approving each call in the app (a call booked for later, or a repeating series, is approved once, when you set it up), or, on Simp Pro, in advance in autonomous mode.

Autonomous mode. On Simp Pro, autonomous mode is your say-so given in advance, as rules you set for your connected AI apps. A call an app sets up that fits your rules goes ahead without waiting for you to approve it. You set the rules, you can change them or turn autonomous mode off at any time in the app, and you are responsible for every call made under them.

During a call. When your simp reaches something you have said needs your approval, it asks you in the app. If you say no, or do not reply, it does not agree to it.

Sensitive details. Your simp uses a detail you have marked as sensitive only after you approve it in the app, each time, including on a call made in autonomous mode. If you say no, or do not reply, it does not use it. Everything else follows your sharing settings and the rules you set. You are responsible for what you approve.

Taking over. While your simp is on a call you can listen live, take over the call or end it, in the app.

Connected AI apps. On every plan you can connect any AI app we support. A connected app can set up a call for you within the settings you choose, and the call waits for your approval, unless it fits your say-so given in advance in autonomous mode, which is on Simp Pro only. Each app is run by another company under its own terms.

12. Limits, top-ups and extra numbers

AI minutes. Each plan has a monthly allowance of AI minutes, shown in section 4, at checkout and in the app. Your allowance refills every month on the day of the month your plan started, or on the last day of the month if that month is shorter, including when you pay every 3 months. Unused minutes do not carry over. When your minutes run out, your simp cannot start new calls until your allowance refills or you buy a top-up.

Top-ups. You can buy extra AI minutes in the app or in your account. The price is shown before you pay. A top-up is a one-off charge, does not renew and is not refunded.

Extra AI numbers. You add extra AI numbers in your account on our website, up to your plan's limit. Each costs $4.49 a month, or $13.47 every 3 months on a plan paid up front, plus applicable sales tax, and renews with your plan until you remove it. An add-on bought part-way through a billing period is charged for the rest of that period, and then in full with each payment.

Your AI number. We give you an AI number when your plan starts. You cannot choose it, and it cannot be moved (ported) to another provider. We may change it if the law, a regulator or a phone provider requires it. When your plan ends, we hold your AI numbers for 30 days, after which they are released.

Time limits on calls. We set time limits on calls, and the app shows the limits that apply to you. Today, a call ends after 10 minutes, and a call that has been on hold for 6 minutes ends then, whether or not your simp has finished. We may change these limits; the app always shows the ones in force. You can take over a call at any time, in the app.

Calling hours. Your simp makes calls only between 8am and 9pm, in the time zone of the person or business being called. Calls to a toll-free number follow these hours in your own time zone.

Safety limits. We set limits on how much calling and spending one account can do, to stop misuse.

13. Acceptable use

You must not use Simp, or ask your simp, to:

  • do anything unlawful;
  • harass, threaten or abuse anyone, or call someone who has asked not to be called;
  • deceive anyone, impersonate anyone, or pretend a call comes from somewhere it does not;
  • commit fraud, or obtain information you have no right to;
  • make telemarketing, sales, fundraising, debt collection or political calls, or surveys;
  • call numbers in bulk, or run a calling service for other people;
  • record a call, or let anyone else listen to it, without the consent the law requires;
  • interfere with Simp, or get round its limits; or
  • resell your plan, your AI number or your simp.

If you break this section, we may stop a call, stop your simp making calls, or suspend or close your account, and we may report it to the police or a regulator.

14. Rewards

Spins. Simp+ comes with spins (1 a week), and Simp Pro comes with spins (1 a day). Spins are run under the Spins Official Rules, which apply to every spin.

Coins. Simp+ and Simp Pro earn coins every day, at the rate shown in the app. Coins can be used only for perks in the app, such as extra AI minutes or a small credit on your bill. They cannot be bought, sold, transferred or swapped for cash. Coins expire 6 months after you earn them, and all your coins expire when your plan ends.

Referrals. When a friend you refer joins, they get 2,000 coins once their first bill is paid. You get a credit on your bill, depending on the plan you are on when it is paid, only once your friend has stayed for 3 months in full.

Your planYour reward
Simp+$5
Simp Pro$10

We may change or end rewards at any time. A change never takes away a prize you have already won.

15. Your content

Your content is what you put into Simp and what your calls produce. You keep whatever rights you have in it. You give us permission to use it to provide, secure and improve Simp, as our privacy policy explains. You promise you have the right to give us your content, including any details about other people.

The Simp app, our website, the personas and their voices, and the Simp name belong to us. While you have an account, you may use the app and the site for your own affairs. You may not copy, sell, scrape or reverse engineer them.

16. Our responsibility to you

Your simp can get things wrong. Check the summary, and the transcript where it matters, before you rely on a call.

Simp is provided as is and as available. To the fullest extent the law allows, we give no promises other than those in these terms, including no implied warranties of merchantability, fitness for a particular purpose or non-infringement. We do not promise that Simp will always be available or that a call will connect or get the result you want.

Limits on what we pay. To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data or opportunity. Our total liability for all claims relating to Simp is limited to what you paid us in the 12 months before the event that led to the claim.

These limits do not apply to liability for fraud, gross negligence or willful misconduct, for death or personal injury caused by our negligence, or to anything else the law does not allow us to limit.

17. Suspending or closing your account

We may suspend your service or close your account straight away if you break these terms, if we believe your account is being used for fraud or misuse, or if the law requires it. Nothing works while your service is suspended.

18. Disputes and arbitration

Please read this section carefully. It affects your rights.

Notice first. Before starting an arbitration, the person with the dispute sends the other a written notice describing it and what they want. Yours goes to hello@simpmobile.com; ours goes to the email on your account. We then have 60 days to try to settle it.

Agreement to arbitrate. You and we agree that any dispute between us relating to these terms, Simp, your account, your calls, rewards or your personal information will be decided by binding individual arbitration, not in court. The Federal Arbitration Act governs this section. The only exception is that either of us may bring an individual claim in small claims court, as long as it stays there.

No jury, no class actions. You and we each give up the right to a jury trial. You and we may bring claims only as individuals, never as a plaintiff or class member in any class, collective, consolidated or representative action. The arbitrator may not combine more than one person's claims or award relief to anyone but the individual party.

Rules and fees. The American Arbitration Association (AAA) runs the arbitration under its Consumer Arbitration Rules, and its Mass Arbitration Supplementary Rules where they apply. We pay the AAA's fees, apart from any filing fee its consumer rules ask you to pay. Any hearing is by video or phone unless you ask for it to be held in the county where you live.

Opting out. You can opt out of this arbitration agreement within 30 days of first agreeing to these terms by emailing hello@simpmobile.com with the subject "Arbitration opt-out", giving your name and the email on your account.

If part of this fails. If the class action waiver is found unenforceable for a claim, that claim is not arbitrated and goes to a court in the county where you live. Where the law does not allow a claim for public injunctive relief to be arbitrated, that claim goes to that court after the individual claims are arbitrated. The rest of this section still applies.

19. Which law applies

These terms are governed by the Federal Arbitration Act, other federal law of the United States, and the law of the state where you live.

20. Changes to these terms

We may change these terms. We tell you by email at least 30 days before a change takes effect. If you do not want the change, cancel before it takes effect. If you keep using Simp after it takes effect, you accept the new terms.

21. Calls and messages from us

By giving us your phone number, you agree that we may call or text it about your account and the service, including a call from your simp's AI voice when you join.

We send you the messages the service needs, such as receipts and notices about your account. We may also send you marketing email about Simp. Every marketing email has a link to unsubscribe.

22. General

  • The whole agreement. Your agreement with us is these terms, the Spins Official Rules and the details of your plan shown at checkout.
  • Transfer. We may transfer this agreement to a company that takes over Simp. You may not transfer your account or this agreement.
  • Events outside our control. We are not responsible for a delay or failure caused by something we could not reasonably prevent.
  • If a term cannot be enforced, the rest of these terms still apply.
  • Electronic records. You agree to receive these terms, notices and receipts electronically.
  • Sanctions. You may not use Simp if you are on a US or UK sanctions list or live in a country under comprehensive US sanctions.
  • Nothing in these terms limits a right that the law says cannot be limited.

23. California notice

Under California Civil Code section 1789.3, California residents may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (916) 445-1254 or (800) 952-5210.
